The Calcutta High Court directs central soldiers to be stationed in West Bengal for a further 10 days in order to prevent post-election violence.
After observing that the petitioners' worries about the post-election violence appeared justified in light of related incidents that had happened in 2018 and 2021 following the release of the election results, the Court made its decision.
The Calcutta High Court decided on Thursday that central paramilitary soldiers must be stationed in West Bengal for an additional ten days following the declaration of the results of the upcoming panchayat elections.
A division bench composed of Chief Justice TS Sivagnanam and Justice Uday Kumar issued the ruling after noting that the petitioners' worries about post-election violence were justified in light of similar incidents that happened after the announcement of election results in 2018 and 2021.
"Given the past history, there is worry of post-election violence that cannot be dismissed. We only care about the protection of the general public, and if such violence occurs, it will have an impact on the public. Violence after elections is a possibility since winning candidates may celebrate, etc. As a result, the bench mandated that the Central forces continue to be deployed for an additional 10 days following the pronouncement of results.
The State Election Commission (SEC) informed the bench during the hearing of the case on Thursday that it would not be able to order the continuation of the forces after July 12, when the election results would be announced.
"Our legal authority would expire the day the results were announced. So, only until July 12 can we order deployment. After that, either the court can make an order for it or the nodal authority of the Central government can make a decision of that nature, senior attorney Kishore Datta said the bench.
The bench agreed with the arguments and mandated that the central forces' deployment continue.

"पिछले इतिहास को देखते हुए, चुनाव के बाद हिंसा की चिंता है जिसे खारिज नहीं किया जा सकता है। हम केवल आम जनता की सुरक्षा की परवाह करते हैं, और यदि ऐसी हिंसा होती है, तो इसका जनता पर प्रभाव पड़ेगा। चुनाव के बाद हिंसा एक है संभावना है क्योंकि जीतने वाले उम्मीदवार जश्न मना सकते हैं, आदि। परिणामस्वरूप, पीठ ने आदेश दिया कि परिणामों की घोषणा के बाद अतिरिक्त 10 दिनों के लिए केंद्रीय बलों को तैनात किया जाना जारी रहेगा।
राज्य चुनाव आयोग (एसईसी) ने गुरुवार को मामले की सुनवाई के दौरान पीठ को सूचित किया कि वह 12 जुलाई के बाद बलों को जारी रखने का आदेश नहीं दे पाएगा, जब चुनाव परिणाम घोषित किए जाएंगे।
"परिणाम घोषित होने के दिन हमारा कानूनी अधिकार समाप्त हो जाएगा। इसलिए, केवल 12 जुलाई तक ही हम तैनाती का आदेश दे सकते हैं। उसके बाद, या तो अदालत इसके लिए आदेश दे सकती है या केंद्र सरकार का नोडल प्राधिकरण इस पर निर्णय ले सकता है।" प्रकृति, वरिष्ठ वकील किशोर दत्ता ने पीठ ने कहा।
पीठ ने तर्कों से सहमति व्यक्त की और आदेश दिया कि केंद्रीय बलों की तैनाती जारी रहेगी।
